Federal basis
2018 Farm Bill §10113 exempts hemp-derived cannabinoids ≤0.3% delta-9 THC; DEA Interim Final Rule (2020) classifies synthetically derived tetrahydrocannabinols as Schedule I. Pending federal litigation and the 2024 Farm Bill reauthorization debate may resolve the conflict.

Safety notes
- Most delta-8 THC on the market is synthesized from CBD using acidic reagents. Residual reaction byproducts including unknown isomers may be present in poorly manufactured products. Third-party COAs are essential.
- Delta-8 produces psychoactive effects and impairs driving. Treat dosing similarly to delta-9 THC.
- Delta-8 THC will produce a positive result on standard drug tests for THC metabolites.

Delta-8 THC is the most contested hemp-derived cannabinoid in the US market. It emerged commercially after the 2018 Farm Bill made hemp-derived CBD federally legal, and producers discovered that excess CBD inventory could be converted to delta-8 THC, which produces a milder version of the delta-9 THC high.
Federal status: unresolved
The 2018 Farm Bill's plain language exempts hemp-derived cannabinoids with ≤0.3% delta-9 THC from the Controlled Substances Act. The Ninth Circuit ruled in AK Futures v. Boyd Street Distro (2022) that delta-8 THC derived from hemp falls within the Farm Bill's exemption. The DEA's position remains that synthetically converted cannabinoids are controlled substances. The conflict is unresolved and the 2024 Farm Bill reauthorization is expected to address it.
State status: fragmented
As of 2026, delta-8 THC is banned outright in roughly 14 states, restricted (age limits, retail rules, potency caps) in another 10+, and legal under default Farm Bill rules in the remainder. The list changes frequently. Always check the state hemp block on your state page.
What it actually is
Most delta-8 THC sold in the US is not extracted from hemp directly. It is synthesized from CBD using an acid-catalyzed isomerization reaction. The quality of the final product depends heavily on manufacturer purification. Third-party COAs should disclose delta-8 THC content, residual delta-9 THC content, and the absence of reaction byproducts.
